UPDATE: ATF response to firearms sales via "courier"

Some may remember, I sent a letter to the ATF on February 14th, 2008 asking for clarification about shipping a firearm between two unlicensed parties in the same state via a "private shipper". As in another member here as a courier.

Well, they FINALLY got back to me with a letter today reiterating what we all expected to hear. In a nutshell, it is perfectly legal. I'll post the letter in it's entirety tomorrow when I get back to work and scan it in.
This might be a handy letter to have in the car just in case someone is performing courier duty for two other members. The letter is signed by the chief, firearms programs division.

Hey Jon, was the scenario that you painted one where the buyer paid the seller separately or was the courier to act like an "escrow agent" to pay the seller upon delivery of the gun?

Separate payment arrangements. Just like if you tendered it to UPS.

I would assume if you gave the money to the "transporter" to act as an escrow it would really be two transfers of title. Once to the escrow agent and once to the end user when it was transported wherever. I would think this would be an even more legitimate process as all t he firearms transactions were face to face. Assuming all parties involved could legally purchase and own said firearm.

On the flipside, if you acted as courier and escrow agent often enough, it could land you in some issues as well if that's how they view it. I don't think under UCC law, title is actually passed to the escrow agent, but I'd think you would just want to just handle the transportation just in case.
