Florida Statute 790.06 wrote:For the purposes of this section, concealed weapons or concealed firearms are defined as a handgun, electronic weapon or device, tear gas gun, knife, or billie, but the term does not include a machine gun as defined in s.

you'll also note that nowhere in the statute does it mention AOW. [smilie=033.gif]

Heres a thought... all you people that have NFA trusts set up for SBR or AOW etc... you have a CWL not the trust entity . You don't own the SBR, the trust does.... :-k so can you carry a SBR,sbs AOW? Eh.......?

I was thinking this as well. Handgun and pistol are generally synonymous terms, but I wonder if their definition is different? I'm not sure, but in my head an AR pistol is not a handgun, but does receive the same treatment on a 4473.

Gotta' think the reaction from citizen and cop would be very different than for a regular type handgun, if it were seen or called into action.

I don’t think that a “rifle caliber” would be skating the line at all.

I’ll bet that more .22 long RIFLE cartridges are used for the purpose of rifle shooting than pistol – does that make it a “rifle caliber?” So if some individual shoots a 30 caliber carbine cartridge in his/her revolver does that make it iffy to carry concealed? There is a .50 BMG pistol – is that legally iffy to carry concealed?

I don’t think so.

The one thing that the law has going for it are definitions; if it’s NOT a rifle, or an NFA or AOW type firearm then its got to be a pistol –regardless of the caliber.

In my not-so-humble opinion, of course.

Neither term is defined in the statutes but "firearms" is.

How about all the derringers that shoot .410, or the Taurus Judge for that matter, it's obviously a pistol regardless of what it shoots. I think that given the absence of a FL defined handgun clause they would have to interpret it in favor of the citizenry..... or at worst default to the atf's definition. IIRC their definition states that a handgun is designed to be shot with one hand, which is why adding a front vertical grip on certain handguns causes a SBR issue.....the front vertical grip gives a specific spot for a 2nd hand which "proves" it was designed to be used that way. I say "proves" because it doesn't "prove" the design intent any more than a speedometer with a mark at 120mph "proves" that my truck was designed to be used at that speed.

What about CCW flashbangs?

Assuming they are on the NFA books and you have a valid concealed carry permit?

Seems like a fuzzy area. Wouldn't you have to be about 7 feet tall to carry a concealed rifle. What happens when you are seated while driving or dining out?
