Wasn't there a recent court ruling that acknowledged the right of citizens to record police activity?
Coupled with the right not to answer questions could result in lots more neutering of these checkpoints.

I believe that there is an amendment to our constitution which provides that I do not have to answer any questions asked by law enforcement.

I'm hoping that a LEO will address this question.

However I'd surmise that the driver has to show signs of being impaired prior to being asked to step out for further testing. I could be very wrong though. :-k

I'm not up on the laws governing recording police activity. For some reason I thought it was a state law issue.

a smart officer, once he realized what the driver was doing would say " at this time sir, I smell an odor of alcohol coming from your vehicle, please put it in park and step out "

then toss his phone down the street shattering it into 100 pieces, then just tell him get back in the car asshole [smilie=011.gif]
In the days of the old west a 6 shooter was as common as cell phones are today and just annoying if they go off in a theater.

Driving is a privilege - is that the excuse for stopping a vehicle without probable cause? If so that's a slippery slope, at some point walking on a public street will be a “privilege.”

Smart supervisor - but I wouldn't advise doing what this person did - Rentprop1 is right.

If you’ve done nothing wrong you have nothing to hide, right? WRONG! Every year our justice system puts innocent individuals in prison and allows some of the guilty to walk free. Ours is not a perfect system. Because of the proliferation of laws and overcrowding of our courts our justice system is a factory line where most suspects are offered a choice between two extremes. Gum up the works by having the audacity to ask for a jury trial (one of our rights) and you could pay with your life. For example, you can plead guilty to felony jaywalking or go to trial and be charged with first degree murder and face the death penalty. Most people, even if they were innocent wouldn’t want to chance the probability of death or decades in prison. So every day innocent people take a plea deal and plead guilty to a lesser charge.

The next time that someone says, “If you’re innocent you have nothing to hide” tell them that when the justice system is perfect and never makes a mistake you’ll take their advice, until then you’ll keep your rights.

If more people resisted this kind of illegal LE activity we wouldn't have this kind of non-PC stops happening. By resist I mean complain to your congressman, call the police and complain, write the local paper, try to get others to see how this is wrong. I don't think being so confrontational toward the soldiers of our government is the best path - however YMMV.

It's only evidence if a crime has been committed; no crime - no evidence. And for those that may say that destroying private property is a crime – accidents happen. Who’s to say whose fault it was? Would you sue the police for $200 damages? It’s too bad that there's a lot of LE that would do exactly what Rent said – and there isn’t a thing that a citizen could do without costing themselves more money than they’d receive.

I love it. I almost don't have it in me to be that much of a jerk about it, but when a police department decides to stop and question people without any sort of suspicion whatsoever, they started it.
...and they think I'm compensating for something?

I got stopped the other night in a DUI checkpoint, was interesting, but I dont think doing what the driver in the video did would have helped anything...and would have certainly ended up causing more problems than not.

Another interesting fact, they were only stopping every 4th vehicle in this checkpoint. I dont like DUI drivers at all, but I also dont like being detained because of these checkpoints.. so im very conflicted about them.

Two weeks ago I was coming home from a ski trip, in Italy, and my train was delayed over an hour by snow storm so missed my connection. I had called one of the guys in my crew, (with over 3 hrs notice), to come pick me up, a 1/2 hour drive to train station. On the way back, just 2 miles from home we got pulled over for random check by Italian police, I didn't even realize it but he was hammered and got busted. Italian cops were nice enough about it, but all business, had to bring in a local interpeter and they were going to sieze the car right there (thats what they do here) until they realized it was a company rental. I had to blow also (sober,) and the car had to be signed over to me on the spot, and I had to sign responsability that my workmate would not be allowed to drive in Italy until completition of as yet to be determined court outcome.
Two nights ago, (Sat night) I came out of a restaurant, got in my personal rental car (leased in France), drove 100 yrds and got pulled over in random check by Austrian police. (At least the Austrians generally have english as second language.) First he was pissed off because I didn't have an international drivers license, ( it's suggested but not really required) but I didn't push the issue 'cause he was real serious. He asked if I had been drinking, and three of us had spilt a bottle of wine over a steak dinner so I wasn't to worried so said yes, had a glass, and had to do the blow test. He looked real dissapointed when he handed my license back and told me I could go and walked away. I'm like, hey wait a minute and called him back, he looks back in and I ask him what the result was. (007) I just laughed. When I texted my skiing buddies if they got stopped they laughed and said no, the cops were busy with me when they drove by.
They're real strict about some things over here and I don't feel like spending the night in an Italian/Swiss/Austrian/French jail.
All four tires MUST be snow tires AND you MUST have chains in the car. No snow tires and you get in an accident, your fault or not, and you insurance is invalid and you'll probably end up in jail. Safety kits with triangles and reflective vests have to be in the cars, not in the trunk. As of April 1, in France and your required to carry your own personal DUI test kit in the car. Anything that can act as a radar detector or speed camera warning device is a BIG no-no , like TomTom etc. As a non resident I'm not allowed to own a car in Italy, I have to rent or lease only. Lots of things that would never fly in US.

Since we are used to seeing that the LEO's usually gets their way, it is interesting how they let him go.

Hypothetically ! They let this guy go after they stopped him, a few blocks away he hit someone with his car and kills the person. Turns out that the guy stopped earlier had in fact been drinking. What happens to officer Aaron Johnson ?

Same thing that would have happened if Officer Johnson saw his car drive by and did not have any suspicion that he was drunk. Nothing.

I don't like drunk drivers, but I don't support unconstitutional laws that hassle the rest of us and put us in peril to put them behind bars. Same as I don't like street thugs committing armed robbery, but don't feel I should be searched and have my gun checked out by a cop without reasonable suspicion or probable cause.
