Got pulled over today...

Postby Enoch » Mon Jan 02, 2012 3:42 pm

Quick story and a question...

I got pulled over by a motorcycle cop today for speeding. When he came up to the passenger window, I immediately informed him that I had a CWP and a gun in the car. (I know I don't legally have to do this, but I have always chosen to be upfront in these situations and it has always been a positive experience). The officer was very cool and calm, just asked where it was. I told him it was zipped in a rug in the driver's door pocket. He said "ok, just leave it there and after you give me your license and registration, just keep your hands on the wheel so I can see them". I asked him if he wanted my CWP and he said "naw, I don't need it"

Well... he did end up giving me a speeding ticket, but he was very calm and professional in regards to my gun. He also said that he put a note in the computer with my name and tag so that future officers, if they pulled me over, would know that I usually carry a gun in the car. Huh? Has anyone heard of that before? I worry that the next LEO may not be so professional and that info could cause a future traffic stop to have me treated like a threat.

Well... time to call Stephen Lustig, Esq and make this ticket disappear :ham'r

"Well... he did end up giving me a speeding ticket,"

"put a note in the computer with my name and tag so that future officers, if they pulled me over, would know that I usually carry a gun in the car."

From this angle, it looks like being upfront did not help at all - just the opposite.
When do I get some stimulation in this economy??

Hmmmmm.... :-k I don't think I like that at all.

PS... Been CCW for 15 years. Been pulled over a few times. I've never informed the officer, and I plan to continue that approach. It's superfluous information and irrelevant to the traffic stop that can do nothing to help the situation... and it MIGHT create an unnecessary s***storm.

The police can list any note they want next to your name in their computer systems. No laws I know stop them from doing this. Right or wrong it is just the way things are done now from what I have gathered . Storage is so cheap now they can store a ton of info not possible just a few years ago. I have no idea how far and wide the info is being shared and if all depts do this. I doubt it is an organized effort, tin foil types may think different. If my understanding of this is totally wrong I am open for correction from the LEO's on the board.

I suspected that myself, I thought for sure that notes are being made in the computer. I got pulled over a few times. The first time I got pulled over, I know why the LEO asked me if I have a gun in my car, its because I had a NRA sticker on my rear quarter window.

After I removed the NRA sticker I got pulled over again, normally they ask you if you know why they pulled you over. No not this guy, this go around the first thing the LEO asked ..... if a have a gun in the car. It could be coincidence but I sort of doubt it.
As I have grown older, I've learned that pleasing everyone is impossible,
but pissing everyone off is a piece of cake.

I hear what you're sayin. The ONE time out of 1/2 dozen I didn't volunteer that info, he out-of-the-blue asks me if I have any weapons in the car. Of-course I said "I have a CWP and yes I have a pistol in the car". He didn't blow a full nut but he blew half a nut and things got a little tense for about 20-30 seconds. He ended up not even giving me a taffic citation, but he lectured me about not volunteering that I was carrying. I didn't want to argue about the law because I was grateful for not getting a citation.

I know it's not required to divulge, but if I was a LEO, I would appreciate the courtesy, and in the past, this courtesy seems to have worked in my favor. Hopefully these notes are simply a department shared database. I don't have anything to hide, but I would hope to not have a prejudicial situation if I am pulled over
in the future

That's funny. I never put the sticker on my car for that reason. Plus I thought some low life may target my vehicle for theft, in the hopes that I may have left a gun in the car. :ber

"I don't have anything to hide, "

My advice: when saying this phrase, always follow it up with "... but I do have everything to protect."

In this case it was about protecting your privacy concerning non-consequential items in your vehicle during the stop.

BINGO! I'm always STUNNED over how easily people will give up their essential liberties by prefacing with "I have nothing to hide." Truly frightening! That's like jumping onto the slippery slope after greasing up your ass.

That cop is a moron to think he is helping anyone. Be prepared for a couple of backup units and a standoff next time a taillight is out.

And what is a future officer?

So, concealed carry license info is not included in the drivers' license data?

My wife's cousin is an officer in Vero Beach and I asked him that specific question and he said "no" that information does not come up when they run your tag or DL.

Only if you're feeling froggy.

790.06 License to carry concealed weapon or firearm.—
(1) The Department of Agriculture and Consumer Services is authorized to issue licenses to carry concealed weapons or concealed firearms to persons qualified as provided in this section. Each such license must bear a color photograph of the licensee. For the purposes of this section, concealed weapons or concealed firearms are defined as a handgun, electronic weapon or device, tear gas gun, knife, or billie, but the term does not include a machine gun as defined in s. 790.001(9). Such licenses shall be valid throughout the state for a period of 7 years from the date of issuance. Any person in compliance with the terms of such license may carry a concealed weapon or concealed firearm notwithstanding the provisions of s. 790.01. The licensee must carry the license, together with valid identification, at all times in which the licensee is in actual possession of a concealed weapon or firearm and must display both the license and proper identification upon demand by a law enforcement officer.
