Good and bad police experience today.

State and national practical & political discussions on legal open, concealed and vehicle carry.

Good and bad police experience today.

Postby captain steinbrenner » Sat Aug 27, 2011 12:00 pm

I took my dog to the vet this morning and while coming back I got stopped by a Palm Springs cop due to speeding, I honestly was doing 40 on a 35 he said I was doing 48 [-X
Regardless, first thing I do is put my hands on the wheel and let him know that I had two guns inside my car.
As soon I said that he called for backup, he was very nice and respectful all the time.
When the other officer showed up he was very excited and almost yelling "Where are the guns? We're taking e'm! Get out of the car!"
I of course kept my cool and told him where they where as I stepped out he said "You know, we don't like people with guns! Who you think you are with so many guns? You think they coming to get ya?!" =:wvr
I told him that I had all legal rights to have them and that I wasn't breaking any laws but that I respected his opinion even that I didn't agree with him.
While the first cop was checking my DL he padded me and grabbed my dick with balls and all, not kidding guys. [smilie=014.gif] I've been padded before and never had my dick touched like this guy did. Very embarrasing. ](*,)
The other cop told him that I was clear and that I had been acting in a very profesional way and that he appreciated me letting him know about the guns.
To he replied "Well if he didn't say nothing about it I would be arresting him right now! Is illegal not to let us know! You undestand!! he yelled while pointing his finger at my head like a gun =:wvr
At that point the other cop got feed up with his asshole partner and handed back my CWP and DL and told me to slow down and to have a nice day.
I shook his hand and went my way. They where kind of arguing while I was leaving, I can imagine he felt ashamed for having such a turd as backup :ham'r

I've read this post a few times. Did you get a badge number? I would have acted the same and driven to the pd hq right away. 33 years I've nvr been close to something like that. That can't be tolerated.

This is why I don't volunteer information about a weapon on a routine traffic stop. It generally won't cause your dick to be grabbed but it at the very least will delay your traffic stop unnecessarily.
But yes, I would file a complaint with the PD about the misinformed officer, his attitude and unnecessary escalation of the situation. A terry frisk, while legal was over reacting IMO.

your only error was informing, in FLA you are not obliged to inform, there are many like cop #2 out there and next time he may be the only guy you deal with and things could go real bad with a douche like that

Based on what I've read on multiple forums (and the fact that Florida does NOT require it), I do not and will not volunteer that I CCW during a routine traffic stop. I've been stopped a few times in the 15 years I've had my CCW, and I've never brought it up. IMHO, it serves absolutely no constructive purpose. And, while volunteering the information MAY NOT cause any issue (and even some friendly banter about guns)... it can also BACKFIRE as has been illustrated so many times on these forums.

There are a couple of PBSO deputies on this board. I hope one of them contacts you privately and helps to educate the officers on the ends and outs of CWL in Florida.

Your story illustrates vividly why I subscribe to a don't ask, don't tell philosophy when confronted by LEO. If he/she doesn't ask, I won't tell. I just don't see the need to complicate a simple traffic stop by bringing guns into the situation.
Half of my resolutions to problems come with a cold sweat somewhere around 2 am.

The only time i ever informed a cop i had a gun was on a traffic stop and it happen to be in my glove box so i did not want o pop it open to grab my paper work and he sees it and gets all crazy. I said sir before i open my glove box i am a cwp holder and i have my gun in there. He polietely told me to just make sure it stays in there and that was it.. Of course his true colors showed when he gave me shit about being a firefighter and was not joking about it either! My lisence address had not been updated yet because i had just moved and he said "well with your schedule you dont have time to get a new one?"( very rudely i might add) . Otherwise i dont say anything, but then again i try to not get pulled over either!

=D> Wow, tremendous restraint! I admire your calm while being subjected to that disgraceful behavior!

Q: Did cop #2 just dive in the car assuming he had the right to search the vehicle as well? Please, please, please press this issue with the department.

This cave man, testosterone jacked, f'ing $&/?ole, situation escalating jerk-off needs some instructions in how to behave towards the CITIZENS He Works For!

Jesus Christ!!!

PBSO OTHER LEOs here... Please gentlemen, show us how responsible you are and figure out who this "brother" is so that you can explain to him just how awful his actions are. You could push a perfectly model citizen to do something you don't like with this sort of abusive treatment and voila, there your "collar" quota for the morning. Why do we keep hearing and seeing true stories like this EVERY &@%# DAY!?!?

An update that #2 cop got in some serious trouble for this would go a long way in helping build-back respect for the Dept. On this forum I am sure.

I'm confused. I see comments here saying it is not required that you inform an officer who stops you, that you have a firearm in the car/on your person. When I took my CWL class, the instructor advised us that's the first thing you should do if you're ever stopped. He said you should be giving your CWL with your DL/Registration/Insurance. The officer will almost definitely ask if your carrying. To "remain calm", and advise something along the lines of "Sir, I am a licensed firearms carrier, and I have my firearm/weapon with me (try not to just say something like "I got a gun on me")." Also advise of the condition of the carry, and if the officer would like to temporarily seize the weapon, assuring them that you want to remain safe. He said that if you don't offer this information, and when the officer runs your information, and it comes back that your a CWP holder, and you didn't offer the information voluntarily, your gonna have a fidgety/suspicious cop who may feel your trying to hide something. Is this wrong?

there is a lot of bad info pushed out at those classes, by law in FLA you are not obliged to inform a cop that you are carrying, that said some people believe that informing them is the right thing to do, others think that informing is a bad idea. the OP posted a story of where his informing opened up a can of worms. the decision is yours, but you are not required to inform

First thing. CWL instructors should be required to teach their students and the students should be required to prove they know how to look up and review the state statutes so there won't be so much bullshit passed out as "law" at these classes. The statutes, not the instructor's opinions, should govern our behavior.

790.06 License to carry concealed weapon or firearm.—
(1) The Department of Agriculture and Consumer Services is authorized to issue licenses to carry concealed weapons or concealed firearms to persons qualified as provided in this section. Each such license must bear a color photograph of the licensee. For the purposes of this section, concealed weapons or concealed firearms are defined as a handgun, electronic weapon or device, tear gas gun, knife, or billie, but the term does not include a machine gun as defined in s. 790.001(9). Such licenses shall be valid throughout the state for a period of 7 years from the date of issuance. Any person in compliance with the terms of such license may carry a concealed weapon or concealed firearm notwithstanding the provisions of s. 790.01. The licensee must carry the license, together with valid identification, at all times in which the licensee is in actual possession of a concealed weapon or firearm and must display both the license and proper identification upon demand by a law enforcement officer. Violations of the provisions of this subsection shall constitute a noncriminal violation with a penalty of $25, payable to the clerk of the court.

Second thing. Running your information, in Florida at least, does not automatically indicate that you’re a CWL holder.
