ccw at schools and such

Postby usaf46270 » Sat Nov 19, 2011 4:49 am

We were at a football game tonite, I help out, one of the guys that was helping, started talking about concealed carry, he said you could now carry on school grounds, court houses, every place but federal building, I told him I don't think so, he said yea, the carry laws had changed, I try to stay up on them being I carry, but I never heard of any change. Is this guy blowing smoke or did the carry law change?

I think that was smoke being blown up your dress.

Palm Beach counties court house still has the "no guns" signs up and metal detectors.

In the days of the old west a 6 shooter was as common as cell phones are today and just annoying if they go off in a theater.

Ask the guy to specifically state what new law he's referring to. SB 234 (the non-open carry bill)? Wrong. HB 44 (state preemption)? Wrong.

Then ask him when's the last time he read FS 790.06(12). He'll probably say "What's that?"

You should have checked if he is carrying and if he was, scream GUN .... GUN .... GUN this guy has a GUN.
Then whisper to him and say, well lets see if you are correct . [smilie=popcorn.gif]

If the football game is school sponsored or held on school grounds then NO you still cannot carry there (i.e. the rules have not changed.) If on the other hand the football game is a community organization (Pop Warner, City, County League etc) and not associated with or run by a school or held on school property, then yes you can carry there as the restrictions are on school property and athletic events either professional or school sponsored.

http://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&Search_String=&URL=0700-0799/0790/Sections/0790.06.html
790.06 License to carry concealed weapon or firearm.—...
(12)(a) A license issued under this section does not authorize any person to openly carry a handgun or carry a concealed weapon or firearm into:...
9. Any school, college, or professional athletic event not related to firearms;
10. Any elementary or secondary school facility or administration building;...

It's pretty clear...

The only thing that changed this past legislative session as far as carrying is concerned is the statutes were modified to remove any doubt that brief exposure of your otherwise concealed firearm/weapon is not a violation (how long is "brief" is yet to be determined.)

The other "biggie" was the addition of penalties for the bureaucrats if local governments had illegally added their own restrictions to where you could and could not carry. Courtrooms, Gov't meetings etc are still off limits, however the County Commissioners, City Council, Town Fathers etc can't make/enforce rules to keep you out of government buildings, like your tax office, library, Code Enforcement offices etc. (you could carry in all those places before as you were not restricted by the State Legislature, but you may have been arrested on local regulation violations - violations that were themselves illegal.) Perhaps that's what your buddy heard and he mis-interpretted/expanded it.

As far as I know you can NOT legally CC into a Public or private school or school sporting event, like soccer or football.

However several gray areas were pointed out over on FL Concealed Carry forum in reference to "car lines" and leaving your CCW locked up in your car. Someone found a legal definition of a "facility" in the FL statutes that described a building or structure of some kind so it kind of seemed that parking lots, open to the public, may or may not be covered by the facility clause.

You must have a good-looking wife, or you did something to make him angry at you, then again maybe he’s just jealous… there’s got to be some reason that this guy is trying to get you sent to prison for a few years.
:-k
And I don’t think that a judge will accept a “I heard from some guy helping out at a football game…” as an affirmative defense, then again I didn’t think that being hopped up on Twinkies would work as a defense in a murder case either.

"not readily accessible" are the words you are looking for. doesnt have to be locked. though, if i were away from the car, id probably lock it.
